By downloading, installing, or using the Size Matters mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. We reserve the right to modify these Terms at any time, and your continued use of the App constitutes acceptance of any modifications.
2. Description of Service
Size Matters is a mobile application that allows users to edit photos by resizing fish in their images using artificial intelligence technology. The App is intended for entertainment purposes only. The service includes both free and premium features available through in-app purchases.
3. User Accounts and Eligibility
You must be at least 13 years old to use this App. By using the App, you represent and warrant that you meet this age requirement. You are responsible for maintaining the confidentiality of any account information and for all activities that occur under your account.
4. User Content
4.1 Ownership: You retain all ownership rights to the photos and content you upload to the App ("User Content"). By uploading User Content, you grant us a limited, non-exclusive license to process your photos solely for the purpose of providing our services.

7. In-App Purchases and Subscriptions
7.1 Purchases: The App offers in-app purchases including single photo unlocks and subscription plans. All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions.
7.2 Subscriptions: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel subscriptions by going to your
Account Settings on the App Store after purchase.
7.3 Refunds: All purchases are subject to Apple's refund policies. To request a refund, please contact Apple Support.
7.4 Price Changes: We reserve the right to change subscription prices. Price changes will take effect at the start of the next subscription period following the date of the price change.
8. Intellectual Property
The App, including its design, features, and content (excluding User Content), is owned by Size Matters and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written consent.
9. Third-Party Services
The App uses third-party services for AI processing and other functionality. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the actions or policies of third-party services.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTIES REGARDING THE ACCURACY OR QUALITY OF AI-GENERATED EDITS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIZE MATTERS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

You agree to indemnify, defend, and hold harmless Size Matters and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the App, your User Content, or your violation of these Terms.
13. Termination
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Size Matters regarding the App and supersede all prior agreements and understandings.
